Terms & Conditions

These terms govern your use of Zenith Private Wealth Academy, operated by Zenith Private Wealth (Pty) Ltd, a company registered in South Africa ("Zenith", "we", "us"). By creating an account, purchasing a programme or using the platform you agree to them.

1. Who you are contracting with

The academy, its curriculum and all member services are provided by Zenith Private Wealth (Pty) Ltd, trading as Zenith Private Wealth Academy. Where these terms refer to a contract, that contract is between you and Zenith Private Wealth (Pty) Ltd. You confirm that you are of legal age in your jurisdiction and, if you register on behalf of an organisation, that you have authority to bind it.

2. Acceptance

Continued use of the platform after these terms are published or updated constitutes acceptance. If you do not agree, you must stop using the academy and may request cancellation in line with our Refund Policy.

3. Education only — no financial advice

All lessons, recordings, templates, worked examples, market commentary and downloadable material are provided for general educational purposes only. They are not financial, investment, legal or tax advice, are not a recommendation to buy, sell or hold any instrument, and are not personalised to your circumstances. Trading decisions remain entirely your own responsibility. See our Risk Disclosure for the full statement. We do not guarantee profit, performance or any particular learning outcome.

4. Your account

You must provide accurate registration details and keep them current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts are personal to you and may not be shared, resold or transferred.

5. Licence and acceptable use

We grant you a limited, non-exclusive, non-transferable right to access the material included in your plan or purchase, for your own personal learning. You must not:

  • use the platform unlawfully, fraudulently or for spam;
  • infringe intellectual property, or copy, record, redistribute, resell or publish our material;
  • interfere with security — including malware, probing, scraping, or circumventing technical limits;
  • share account access or attempt to bypass payment or entitlement controls;
  • reverse engineer any part of the platform.

6. Intellectual property

Zenith retains all ownership of the platform, curriculum, video recordings, written lessons, templates, documentation and branding. No rights are transferred to you other than the licence described above. Any content you submit (for example support messages or profile details) remains yours; you grant us a limited licence to host and process it solely in order to provide the service.

7. Service availability

We work to keep the academy available and accurate, but we do not warrant uninterrupted or error-free performance. Curriculum, schedules and features may change as the programme develops. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.

8. Payments, subscriptions and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Membership is billed monthly in advance until cancelled; individual programmes are one-time purchases granting ongoing access while the academy operates. Payment, billing frequency, currency conversion, invoicing, tax and cancellation mechanics are governed by Paddle's Buyer Terms. You may cancel a subscription at any time; access continues until the end of the paid period. Refunds are handled under our 30-day Refund Policy.

9. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations — including sharing account access or redistributing course material. Where reasonable and lawful we will notify you first. On termination your licence ends; we will retain records as described in our Privacy Notice.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the fees you paid in the twelve months before the claim. We exclude liability for indirect or consequential loss, including trading losses, lost profits, lost data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

11. Indemnity

You indemnify Zenith against claims arising from your unlawful use of the platform, your breach of these terms, or content you submit.

12. General

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction over disputes. You may not assign your rights without our consent; we may assign in connection with a merger, acquisition or restructuring. Neither party is liable for delay caused by events beyond reasonable control. If a clause is unenforceable, the remainder continues in force.
